In the following Data Protection Notice, Becker Stahl-Service GmbH (also referred to in the following as “Becker Stahl”, "Becker", “we”, “us” or “our”) provides you with various information about the processing of your personal data when you visit our website at www.becker-stahl-service.de (referred to in the following as the “website”). Personal data is all information relating to an identified or identifiable natural person (such as your first name and surname, your mailing address, your phone number or your e-mail address).

In the following, we would like to inform you in particular what personal data will be processed when you visit our website and make use of its services and features, why this takes place in each case, and your rights in this regard.

PROCESSING OF YOUR PERSONAL DATA WHEN YOU VISIT OUR WEBSITE

a) Data categories affected:
Each time you visit our website, we process the following data:

    The connection data of the requesting device, including the IP address;
    The web pages accessed, including the referring page;
    The date and time of your visit;
    The type and version of the requesting browser and the operating system;     Whe volume of data transferred in connection with your visit.

b) Purposes of processing, legal basis and any legitimate interests:
We process this data for the purpose of making our website available and to ensure its technical operation on the basis of Article 6(1)(b) of the GDPR as well as to identify and eliminate faults on the basis of Article 6(1)(f) of the GDPR. In this connection, we pursue the interest of fault-free use of the website.

c) Duration of data storage:
We erase the data after one year unless, in exceptional instances, we need it for a longer period for the purposes mentioned above. In such instances, we erase the data as soon as the purpose no longer applies.

d) Need for your cooperation in data collection/consequences of refusal:
This data is processed automatically when you visit our website. You cannot use our website unless this data is provided.

PROCESSING OF YOUR PERSONAL DATA WHEN USING THE COIL CALCULATOR

a) Categories of data concerned:
When you use our coil calculator, we process the data you provide within your request, such as the name, address, telephone number or email address.

b) Processing purposes, legal basis and legitimate interests, if applicable:
We process this data to respond to your request on the basis of Art. 6 (1) b) DS-GVO or Art. 6 (1) f) DS-GVO. In doing so, we pursue the interest of dealing with your request.

c) Duration of storage:
We delete this data after your request has been dealt with and the relevant statutory retention periods have expired.

d) Necessity of your cooperation in the collection of data / consequences of refusal:
You only have to provide us with the data that we need to process your request and contact you. If you do not provide us with this data, we may not be able to answer your request.

PROCESSING OF YOUR PERSONAL DATA WHEN YOU CONTACT US

a) Data categories affected:
When you contact us, we process the data you provide in your inquiry, such as your name, mailing address, phone number and e-mail address.

b) Purposes of processing, legal basis and any legitimate interests:
We process this data to respond to your inquiry on the basis of Article 6(1)(b) of the GDPR or of Article 6(1)(f) of the GDPR. In doing so, we pursue the interest of responding to your inquiry.

c) Duration of data storage:
We erase the data when your inquiry has been responded to and after expiration of the applicable statutory retention periods.

d) Need for your cooperation in data collection/consequences of refusal:
You must only provide us with the data we need to process your inquiry and contact you. If you do not provide us with this data, we may not be able to respond to your inquiry.

PROCESSING OF YOUR PERSONAL DATA FOR NEWSLETTERS

a) Categories of data concerned:
If you are in contact with us due to your business activities, we will use your data to send you general newsletters (product recommendations, information about Becker Metals, promotions, surveys, etc.). Further information on the processing of your personal data based on the existing customer relationship can be found at https://www.kloeckner.com/en/group/data-transparency/.

We offer you individual information tailored to your interests via personalised direct marketing. Target groups are formed and analyses are carried out for this purpose. When forming target groups, different groups of people are first defined as part of each e-mail campaign, who are to be addressed with regard to the special offers, events and trade fairs as well as products and services to be offered. The target groups are then allocated. The personal data is analysed individually for you as a person. On the basis of this analysis, an automated processing process is used for each email campaign to decide which target group you are assigned to and which special offers, events and trade fairs as well as products and services are offered to you. During the analysis, we create a profile of you and your company that examines and evaluates the personal data listed below with regard to your previous behaviour as a customer and the behaviour of your company. This allows us to derive preferences for products, the time of purchase and other behaviour-relevant statements. Taking into account further statistical empirical values, Becker draws conclusions about your probable future behaviour and calculates probability values regarding my affinity for certain special offers, events and trade fairs as well as products and services.

This data includes, for example, title; first name and surname; email address; company name, address, customer number, your language; purchasing behaviour and purchasing history (online/offline), as well as services activated for you and used by you; your communication and interaction behaviour in advertising measures, information about my customer advisors and the sales organisation at Becker.

b) Processing purposes, legal basis and, if applicable, legitimate interests:
We process this data for general newsletters as part of our business activities on the basis of Art. 6 (1) f) GDPR and our legitimate interest in promoting sales through promotional communication.

If you have given us your consent in accordance with Art. 6 (1) a) GDPR for personalised direct marketing, we will process your data in order to send you newsletters tailored to your interests and to use your data for target group formation and allocation. In addition, we process your personal data in the event of consent for the purpose of proving your consent on the basis of Art. 6 para. 1 lit. c) in conjunction with Art. 5 para. 1 lit. a), para. 2, Art. 7 para. 1 GDPR.

YOU MAY WITHDRAW YOUR CONSENT AT ANY TIME, IN TOTAL OR WITH REGARD TO INDIVIDUAL PURPOSES OF THE PROCESSING, IN EACH CASE WITH EFFECT FOR THE FUTURE, WITHOUT AFFECTING THE LAWFULNESS OF THE PROCESSING CARRIED OUT ON THE BASIS OF THE CONSENT UNTIL THE REVOCATION. You can declare your cancellation, for example, by clicking on the unsubscribe link in each newsletter or by making the appropriate settings in the Preference Center.

c) Duration of data storage:
We delete from the general newsletters after expiry of the relevant statutory retention periods and, in the case of individualised newsletters based on your consent, after you withdraw your consent. Notwithstanding this, we will delete information to prove your consent 3 years after the end of the year in which you have withdrawn your consent or in which it has expired.

d) Need for your cooperation in data collection/consequences of refusal:
Unless otherwise stated, the provision of personal data is necessary for the business relationship. If data is required, failure to provide it will mean that the service in question cannot be provided. Otherwise, failure to provide the data may mean that we are unable to provide our services in the same form and quality.

RECIPIENTS

Internal recipients: Access to your personal data is restricted to the extent needed and to those persons at Klöckner who need such access in order to fulfill the above-mentioned purposes.

External recipients: We pass on your personal data to external recipients outside of Klöckner only if it is necessary to do so in order to process and respond to your inquiry, it is allowed by law or you have given us your consent to doing so.

External recipients may be the following:

a) Processors
Klöckner Group companies or external service providers that we use for the provision of services, such as in connection with technical infrastructure and maintenance and with the provision of content under contract.

b) Public bodies
Public authorities and government institutions, such as prosecutors, courts or tax authorities to which we are under a binding obligation to disclose personal data by law.

c) Private entities and individuals
Distributors, independent branches, cooperation partners or helpers in cases where this is necessary for performance of contract, you have consented or this is allowed by law.

YOUR RIGHTS

Your rights as a data subject under the General Data Protection Regulation (GDPR) – subject to the applicable legal requirements being met – are as follows:

Access: You have the right of access to personal data concerning you that we process.

Rectification: You have the right to obtain rectification of your personal data. You also have the right to have incomplete personal data completed.

Erasure: In certain instances, you have the right to obtain erasure of your personal data.

Restriction of processing: In certain instances, you have the right to have us restrict the processing of your personal data.

Data portability: If you have provided us with data on the basis of a contract or consent, you have the right to receive the data you have provided in a structured, commonly used and machine-readable format or to have us transmit it to another controller.

Right to object  
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6(1)(f) of the GDPR. We will then no longer process the personal data for the stated purposes unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights and freedoms, or the processing is for the purpose of establishing, exercising or defending legal claims.
Please note the information on opt-out rights with regard to cookies in section V.

Revocation of consent: If you have given us consent to the processing of your data, you can revoke it at any time with effect for the future. This does not affect the lawfulness of the processing of your data prior to the revocation.

Exercising your rights: To exercise any or all of your rights as described above, please contact us at dataprivacy@kloeckner.com or by postal mail at the address under heading I. above. Please make sure that we can clearly identify you.

Right to lodge a complaint with a supervisory authority: You have the right to lodge a complaint with a supervisory authority – in particular, in the Member State of your habitual residence, place of work or place of the alleged infringement – if you consider that the processing of personal data concerning you is unlawful.

AUTOMATED INDIVIDUAL DECISION-MAKING, INCLUDING PROFILING

There is no automated individual decision-making, including profiling, within the meaning of Article 22 of the GDPR, in connection with the use of our website.
